Terms of Service
Overview
Welcome to TacticalSportingGoods.com, operated by Southern Sporting Goods LLC. Throughout these Terms of Service, “we,” “us,” and “our” refer to Southern Sporting Goods LLC. “Services” means our website, online store, products, content, features, and related customer services.
These Terms explain the conditions for using our website and purchasing from our store. Please read them carefully, including the provisions concerning product eligibility, returns, warranties, and liability.
By accessing or using the Services, you agree to these Terms and the policies incorporated by reference. If you do not agree, please do not use the Services. Our Privacy Policy explains how we handle personal information.
1. Eligibility, Legal Compliance, and Accounts
To place an order, you must be at least 18 years old, meet any higher age requirement applicable to your purchase, and have the legal capacity to enter into this agreement.
By ordering, you confirm that you may lawfully purchase and receive the products at your delivery address. You are responsible for complying with applicable laws concerning your possession, transportation, carry, transfer, and use of those products.
Availability on our website does not establish that a product is legal in every location. Restrictions may apply to automatic knives, OTF knives, switchblades, and other products. We may request information needed to verify eligibility and may decline or cancel orders because of legal, shipping, payment, or verification restrictions. These requirements do not relieve us of our own legal obligations as a seller.
You must provide accurate, complete, and current account, billing, shipping, and contact information. Keep your login credentials secure and notify us promptly if you suspect unauthorized access. You may not sell, transfer, or assign your account to another person.
2. Product Information and Responsible Use
We aim to provide accurate product photographs, descriptions, and specifications. Screen settings and lighting may affect how colors and finishes appear. Natural handle materials may vary in grain, pattern, and color. These variations do not excuse a materially inaccurate description or an incorrect item.
Review each product’s dimensions, blade style, opening mechanism, materials, and included accessories before ordering. Contact us if a detail is unclear. We may update listings, discontinue products, or limit quantities and destinations as permitted by law.
Knives and other edged tools require careful handling. Follow the manufacturer’s instructions, use products only for their intended lawful purposes, and store them securely away from children. Website articles and product information are general resources and are not individualized legal advice.
3. Orders, Cancellations, and Returns
Placing an order is an offer to purchase. An order is accepted when we confirm acceptance after processing payment. We may decline or cancel an order because of unavailable inventory, inaccurate pricing, suspected fraud, payment issues, purchase limits, or legal restrictions.
Review your order before submitting it. Contact us immediately to request a cancellation or correction; changes may not be possible once processing or shipment has begun. If we cancel an order after collecting payment, we will promptly refund the amount paid for the canceled items and any associated charges that must be refunded. We will notify you using the contact information provided with your order.
Purchases are for personal or household use and may not be made for commercial resale or export.
Returns are governed by our Return & Refund Policy. The principal conditions are:
-
Eligible items must be returned within 30 days of delivery and must be unused, uncarried, unmodified, and in original condition.
-
Obtain return authorization before shipping anything back.
-
Include the original packaging, accessories, and documentation. Returns accepted without original packaging are subject to a 20% restocking fee.
-
Final sale and clearance items, used or altered products, products damaged through misuse, and returns missing essential components are excluded from ordinary returns.
-
We do not offer standard exchanges. To select a different item, return the eligible purchase and place a new order.
If an item arrives damaged, defective, or incorrect, contact us within five days of delivery so we can investigate and arrange an appropriate resolution. This reporting request and our ordinary return conditions do not limit applicable warranty rights or remedies required by law. The full policy explains return shipping, inspection, and refund processing.
4. Prices, Promotions, and Payments
Prices are displayed in U.S. dollars unless otherwise stated. Applicable taxes and shipping charges are shown during checkout. You authorize us and our payment providers to process the total you approve when placing your order.
Prices, availability, and promotions may change for future purchases. A later price change does not alter an accepted order. Pricing errors are addressed under Section 12.
Discounts and promotional offers are subject to their stated eligibility requirements, exclusions, dates, and limits. Where an offer’s specific terms conflict with these Terms, the specific terms govern that offer.
You must be authorized to use the payment method you submit. Installment or third-party payment options, when available, are also subject to the provider’s separate eligibility requirements and agreement.
5. Shipping and Delivery
We ship to eligible U.S. destinations and eligible APO, FPO, and DPO military addresses, subject to product, destination, and carrier restrictions. We do not offer international shipping outside approved U.S. military mail destinations.
Our Shipping Policy explains processing, estimated transit times, tracking, and delivery assistance. Available shipping methods, charges, and qualifying offers are displayed during checkout. The shipping terms presented when you place your order apply to that purchase.
Processing and transit are separate stages. Delivery estimates may be affected by weather, holidays, carrier operations, or other circumstances outside our control. If we cannot ship within the stated timeframe, we will provide any required delay notice, cancellation option, and refund in accordance with applicable law.
You are responsible for entering a complete and accurate delivery address. Contact us immediately if you find an error. Corrections may not be possible after processing or shipment, and an order returned because of an incorrect address may incur additional shipping charges if resent.
For a delayed, missing, or damaged shipment, contact our support team with your order number. We will assist with the investigation and determine the appropriate resolution. Nothing in this section excludes delivery obligations or customer remedies that cannot lawfully be waived.
6. Intellectual Property
Our website’s original text, photographs, graphics, logos, videos, and design are owned by Southern Sporting Goods LLC or used with permission from the applicable rights holders. Manufacturer names, trademarks, and logos belong to their respective owners. Customers retain ownership of their submissions as described in Section 11.
You may browse the website and save information reasonably needed for your personal shopping and order records. Except as permitted by law or with written permission, you may not reproduce, republish, distribute, sell, or commercially exploit protected content or use our branding in a way that suggests an unauthorized affiliation or endorsement.
No ownership or intellectual property license is granted beyond the permissions expressly stated in these Terms.
7. Optional Third-Party Tools
The Services may include tools or features provided by third parties. Review the provider’s terms and privacy practices before using them.
Where we do not operate or control a third-party tool, we cannot guarantee its availability, accuracy, or performance. Such tools are made available “as is” and “as available” to the extent permitted by law. Any new features we introduce are also subject to these Terms and any additional terms presented with them.
8. Third-Party Links
Our website may link to manufacturer resources, payment providers, or other third-party websites. Those sites operate under their own terms and privacy policies. A link does not, by itself, constitute an endorsement of everything on the linked site.
We are not responsible for third-party content or transactions conducted independently on another website, except where applicable law provides otherwise. Questions about orders placed with us should be directed to our customer support team.
9. Relationship with Shopify
Southern Sporting Goods LLC is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our Store are made directly with Southern Sporting Goods LLC. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and Southern Sporting Goods LLC, including any injury, damage, or loss resulting from purchased products and services. You hereby expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your purchases and transactions with Southern Sporting Goods LLC.
10. Privacy
Our collection, use, and disclosure of personal information are described in our Privacy Policy. That policy controls if there is a conflict with these Terms concerning personal information.
Shopify hosts our store and processes information in connection with providing its services. Shopify’s handling of information is also described in the Shopify Consumer Privacy Policy. Information may be processed by Shopify and other service providers in countries other than your own, as explained in the applicable privacy policies.
11. Reviews, Feedback, and Submissions
We welcome honest reviews and feedback. You retain ownership of the reviews, photographs, and other content you submit.
By submitting content for public posting or promotional use, you grant us a nonexclusive, worldwide, royalty-free license to reproduce, display, distribute, and format that content to operate and promote the Services. We may allow service providers to exercise these permissions on our behalf. We will not change a review’s meaning or misrepresent your experience. This license does not apply to private customer support correspondence merely because you send it to us.
Submissions must reflect your actual experience where applicable, respect others’ intellectual property and privacy, and disclose any material connection or incentive associated with a review. Do not submit impersonations, fabricated reviews, malicious code, or unlawful content.
We may moderate spam, irrelevant material, private information, abusive content, or demonstrably false or unlawful submissions. We do not prohibit or penalize honest negative reviews. No provision of these Terms restricts your right to share a truthful opinion or exercise rights protected by consumer review laws.
Unless separately agreed, submitting feedback does not entitle you to payment or require us to use or respond to it.
12. Errors and Corrections
Occasional errors may affect descriptions, prices, promotions, availability, or shipping information. We may correct inaccurate information and, where legally permitted, cancel an affected order.
If a material error affects your purchase, we will contact you about the available resolution. We will not charge a higher corrected price without your authorization. If the order is canceled after payment, we will promptly refund the applicable amount. Corrections do not remove rights you have under applicable law.
13. Prohibited Uses
You may use the Services only for lawful purposes. You may not:
-
Submit fraudulent orders, use unauthorized payment information, impersonate another person, or provide materially false information.
-
Threaten or unlawfully harass customers, employees, or others.
-
Infringe intellectual property rights or disclose another person’s private information without authorization.
-
Upload malware, send spam, or interfere with website operations.
-
Access accounts or systems without authorization, harvest personal information, or bypass security controls or access restrictions.
-
Copy, scrape, resell, or commercially exploit protected website content without authorization or another lawful basis.
-
Use automated tools contrary to Section 14 or applicable access restrictions.
These restrictions do not prohibit honest reviews or other legally protected activity. We may restrict access or suspend accounts in response to violations, subject to applicable law.
14. Automated Agents
An “Agent” is software or a service that takes autonomous or semi-autonomous action on a person’s behalf when accessing or interacting with the Services.
Agents must identify themselves and comply with applicable access restrictions. In HTTP or HTTPS requests, an Agent must identify itself in its user-agent string using the format Agent/[agent name].
Agents must not conceal their automated nature, impersonate human interactions, complete or circumvent CAPTCHAs designed to distinguish humans from computers, or bypass measures that block or limit access. They must answer truthfully when asked whether an interaction is automated.
We may limit or block Agent access. An Agent must stop accessing the Services when instructed to do so. Compliance with these identification requirements does not override another restriction or grant permission for otherwise prohibited activity.
15. Suspension and Termination
We may suspend or terminate access to the Services for a breach of these Terms, suspected fraud, unlawful activity, security concerns, or another lawful reason. You may stop using the Services at any time.
Termination does not cancel amounts properly owed, eliminate obligations for accepted orders, or remove applicable return, refund, warranty, or consumer rights. Provisions that by their nature must continue after termination will survive, including intellectual property, permitted use of submissions, liability, indemnification, and dispute-related provisions.
16. Warranties and Disclaimers
Product warranties, when offered, are governed by the written warranty terms applicable to the particular product. Contact us if you need help identifying the appropriate warranty process. Our ordinary return window is separate from any applicable warranty coverage.
TO THE FULLEST EXTENT PERMITTED BY LAW, THE WEBSITE AND OPTIONAL ONLINE FEATURES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” WE DO NOT GUARANTEE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE OPERATION.
EXCEPT FOR EXPRESS WARRANTIES WE PROVIDE, APPLICABLE MANUFACTURER WARRANTIES, AND WARRANTIES THAT CANNOT LAWFULLY BE DISCLAIMED, WE DISCLAIM IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT TO THE EXTENT PERMITTED BY LAW.
Nothing in these Terms overrides an express product warranty, excuses a materially inaccurate product description, or excludes rights and remedies that cannot legally be limited. Some jurisdictions restrict warranty disclaimers, so some exclusions may not apply to you.
17. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, SOUTHERN SPORTING GOODS LLC, SHOPIFY, AND THEIR RESPECTIVE AFFILIATES, OFFICERS, EMPLOYEES, CONTRACTORS, SERVICE PROVIDERS, AND LICENSORS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM THE SERVICES OR PRODUCTS, INCLUDING LOST PROFITS, LOST BUSINESS OPPORTUNITIES, OR LOST DATA, EVEN IF ADVISED THAT SUCH DAMAGES WERE POSSIBLE.
This limitation does not exclude liability for fraud, willful misconduct, gross negligence, or any injury, loss, statutory remedy, or other liability that cannot lawfully be excluded or limited. It does not eliminate refunds, warranties, or other obligations expressly provided by us or required by law. Where a limitation is not permitted, liability is limited only to the extent the law allows.
18. Indemnification
To the extent permitted by law, you agree to indemnify and hold harmless Southern Sporting Goods LLC, Shopify, and their respective affiliates, personnel, and service providers from third-party claims, liabilities, damages, and reasonable legal expenses to the extent caused by your material breach of these Terms, unlawful conduct, or infringement of another party’s rights.
This obligation does not apply to the extent a claim results from an indemnified party’s own negligence, misconduct, or legal violation. We will notify you of a covered claim and reasonably cooperate in its resolution. You may not settle a claim in a way that imposes obligations on an indemnified party without that party’s written consent, and we will not agree to obligations on your behalf without your written consent.
19. Severability
If a provision is found unlawful or unenforceable, it will be limited or severed to the extent necessary. The remaining provisions will continue to apply to the extent permitted by law.
20. Entire Agreement and Waiver
These Terms, the policies incorporated by reference, and any applicable terms expressly agreed for your purchase form the agreement governing your use of the Services. They replace earlier terms concerning the same subject matter without removing rights already accrued.
Our failure to enforce a provision on one occasion does not waive the right to enforce it later. The Privacy Policy controls privacy matters, and the Return & Refund Policy controls ordinary return procedures, subject in each case to applicable law.
21. Assignment
You may not transfer your contractual rights or obligations under these Terms without our written consent, except where permitted by law. We may transfer these Terms in connection with a merger, reorganization, or sale of the business, subject to applicable law and without reducing your existing rights.
22. Governing Law and Venue
These Terms are governed by Florida law and applicable U.S. federal law, without applying conflict-of-law rules that would displace those laws.
Except where applicable law requires otherwise, disputes arising from these Terms or the Services will be brought in a state or federal court with jurisdiction over Tampa, Florida. The parties consent to jurisdiction and venue in those courts. This provision does not deprive you of mandatory consumer protections or rights to bring a claim in another forum where those rights cannot be waived.
23. Headings
Headings are provided for convenience and do not change the meaning or scope of these Terms.
24. Changes to These Terms
We may update these Terms as our business, Services, or legal requirements change. The current version will appear on this page with an updated revision date.
We will provide notice of material changes and obtain consent where required by law. Changes take effect on the date stated in the update or notice and will not retroactively reduce rights associated with an earlier purchase. Continued use after a change takes effect constitutes acceptance to the extent permitted by law.
